BoF/Wip 3
Telecommunications Facilities Access
Regime and the role of the Australian Competition and Consumer
Commission.
In keeping with the themes to be explored in other sessions on 28 June
a presentation and opportunity for further discussion.
The Telecommunications Act 1997 has reduced telecommunications carriers' immunities from planning and environmental
laws when installing cables, towers and other telecommunications facilities. As a result it is now more important for carriers to be able
to access the existing facilities of other carriers, many of which were established under the old regulatory regime of the Telecommunications Act
1991. Under the facilities access regime established by the standard carrier licence conditions, the Australian Competition and Consumer
Commission has had a role in regulating access to certain facilities, while
the Australian Communications Authority regulates access to other facilities.
